Alimony & Spousal Support

The Law Offices of Peter M. LaSorsa, P.C. represent clients located in Peoria, Tazewell, Fulton and Woodford Counties requiring assistance and advice in family law matters relating to spousal maintenance/support. Illinois courts may order maintenance or alimony during a dissolution of marriage proceeding.

Maintenance is the right to spousal support while the parties are still married. Generally, the courts require a showing that the parties are living apart and separate before maintenance is ordered.

The court reviews a variety of factors when determining maintenance including:

  • The length of the marriage;
  • If one spouse quit a job upon getting married to help support the other spouses career or take care of the children;
  • A disparity of earning between both earners;
  • The age of the parties;
  • The standard of living that both parties have enjoyed during the marriage;
  • The health of the parties;
  • The future earning potential of both parties.

Alimony payments may be awarded during the pendency of a dissolution of marriage or as part of the terms of a divorce order.
