Uniform Interstate Family Support Act ("UIFSA")

The purpose of the UIFSA is to simplify collection of child support or spousal support where the original support order was issued in one jurisdiction but the spouse or the child resides in another state. Under the UIFSA the law of the issuing state governs proceedings under the Act. If there are two support orders in two different jurisdictions, the law of the child's home state controls.

Under the UIFSA there are two methods for enforcement of a support order or income-withholding order issued by a court in another state:

1.   Direct Enforcement via Income Withholding—The spouse may mail the order directly to the employer of the spouse in the other state and the employer must withhold the wages automatically, unless there is a timely objection.

2.   Registration of Support Order or Income-Withholding Order—Under UIFSA you may register a support order with a sister state through Court action. The issuing state sends the order to the state where the spouse resides. After the order is registered the order is subject to the same enforcement procedures as if the Order had been issued in that state.
