In Illinois the Courts will help foster a relationship between the child and both parents by giving the non-custodial parent visitation rights. A visitation schedule takes into account different factors including:
a. the age of the child;
b. the geographic proximity of the custodial and non-custodial parents.
A non-custodial parent right to visitation is independent of the non-custodial parents child support obligation. You may not withhold sending your child to visit the non-custodial parent if that parent is in arrears on his child support payment.
The Court may however, modify the visitation schedule if there is misconduct on the part of the non-custodial parent.
If the custodial parent does not allow visitation, the non-custodial parent may seek a contempt order from the Court.
