Age Discrimination

Many times workers over the age of 40 are either terminated or laid off while younger workers with less experience are not. In age discrimination cases, many times evidence such as hiring records or notes from the hiring manager may play an important role in proving the case.  Usually an older worker will have more experience in a particular job field due to his age.  Unless there is a big education difference, the only justifiable reason for hiring a younger worker would be lower pay and the ability to control the younger worker in a way that the employer does not believe it could with the older worker.  

In Chicago I am seeing more age discrimination cases and I believe this is due to the economic conditions that exist.  As more people are competing for jobs, employers find themselves in the position of picking who they want and keeping a distant eye on some of the discrimination laws.  If you think this is happening to you, call my office to discuss the details.

The Age Discrimination in Employment Act of 1967 (ADEA) was passed to help protect citizens over 40 years of age who have been discriminated against while at work. The ADEA is very broad and it protects employees and job applicants against discrimination based on age.  Accordingly,  it is a violation of state and federal law to discriminate against a person because of age.  The discrimination includes any employment term, working condition, or privilege of employment.  This is a vast list and includes the hiring, promotion or lack thereof, termination of employment, job assignment and training.
