Trademarks

A Trademark is a word or phrase physically stamped on a good or label attached to a good. A Trademark is a unique identifier as to the source of the product.  A Trademark can be owned exclusively and the term may never end--as long as the mark is in use in commerce, the owner's interest continues.

Additionally, Trademarks are monopolies on a word or phrase, with no regard to the independent creativity of a second comer.  The key requirements are first to utilize it in commerce, and the test for any infringement is whether there is a likelihood of confusion between the two marks.
