Negligence

Negligence is the failure to exercise that degree of care which a person of ordinary prudence would exercise under the same circumstances.  What that really means is what would the average person do is a similar circumstance?  So if a balcony railing is so loose that if anyone leans on it they will fall and the owner knows this and does nothing to fix it or put something in place so someone won't lean on it, he is considered negligent. Another words the average person would do something and not let a person lean against he railing and fall.  The injury sustained as a result of someones negligence are not only the medical bills but also lost wages, pain and suffering and any permanent injury that may result.
